How to write a child support claim
In Poland, a child support claim is filed with the district court (Family and Juvenile Division). Remember that the party claiming child support for a minor is exempt from court fees.
Required elements of a child support claim:
- The court: the district court with jurisdiction over the child's place of residence.
- The parties: the claimant (represented by a parent) and the defendant (the other parent, with their PESEL number).
- Value of the claim: the sum of child support for 1 year (for example PLN 1,000 x 12 months = PLN 12,000).
- Main request: the amount of child support payable monthly by day X of each month.
- Justification of costs: a breakdown of monthly spending on the child (food, housing, education, medical care, extracurricular activities).
