Regulamin Świadczenia Usług

§ 1. Postanowienia ogólne

1. Niniejszy regulamin określa warunki i zasady korzystania z serwisu internetowego cvmajster.pl, zwanego dalej Serwisem.
2. Właścicielem i administratorem Serwisu jest firma CVmajster, adres e-mail do kontaktu: kontakt@cvmajster.pl.
3. Serwis świadczy usługi drogą elektroniczną polegające na udostępnieniu narzędzia (kreatora) do samodzielnego tworzenia dokumentów (CV, pism, zaproszeń, plakatów) oraz odpłatnym generowaniu gotowych plików w formacie PDF (lub ZIP dla zaproszeń).

§ 2. Warunki korzystania i realizacja usług

1. Korzystanie z podstawowych funkcji edytora w Serwisie jest bezpłatne.
2. Pobranie wygenerowanego dokumentu w czystej wersji (bez znaku wodnego i hologramu zabezpieczającego) jest usługą odpłatną. Koszt jednorazowego wygenerowania i pobrania dokumentu wynosi 4,99 PLN brutto.
3. Płatności realizowane są za pośrednictwem zewnętrznej bramki płatniczej 1koszyk.
4. W celu sfinalizowania płatności Użytkownik jest przekierowywany do serwisu płatności, gdzie zobowiązany jest podać poprawny adres e-mail oraz wybrać metodę płatności (BLIK, karta płatnicza lub szybki przelew).
5. Po dokonaniu opłaty, Użytkownik wraca do Serwisu, gdzie poprzez wpisanie adresu e-mail użytego do płatności następuje odblokowanie i pobranie pliku.

§ 3. Prawo do odstąpienia od umowy i zwroty

1. Zgodnie z art. 38 ust. 1 pkt 13 Ustawy z dnia 30 maja 2014 r. o prawach konsumenta, prawo do odstąpienia od umowy zawartej na odległość nie przysługuje konsumentowi w odniesieniu do umów o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą konsumenta przed upływem terminu do odstąpienia od umowy i po poinformowaniu go przez przedsiębiorcę o utracie prawa odstąpienia od umowy.
2. Użytkownik, klikając przycisk zakupu i akceptując niniejszy Regulamin, wyraża zgodę na natychmiastowe dostarczenie wygenerowanego pliku PDF przed upływem 14-dniowego terminu na odstąpienie od umowy i przyjmuje do wiadomości, że w ten sposób traci prawo do odstąpienia od umowy i zwrotu środków.
3. Właściciel gwarantuje sprawność techniczną pobieranego dokumentu.

§ 4. Reklamacje

1. W przypadku wystąpienia problemów technicznych z pobraniem opłaconego pliku lub błędów w jego wygenerowaniu, Użytkownik ma prawo do złożenia reklamacji.
2. Reklamacje należy zgłaszać drogą elektroniczną na adres e-mail: kontakt@cvmajster.pl, podając adres e-mail użyty podczas płatności oraz krótki opis problemu.
3. Administrator rozpatruje reklamacje w terminie do 14 dni od ich otrzymania. W przypadku uznania reklamacji, plik zostanie przesłany bezpośrednio na e-mail klienta lub nastąpi zwrot płatności.

§ 5. Postanowienia końcowe

1. Regulamin wchodzi w życie z dniem publikacji w Serwisie.
2. Administrator zastrzega sobie prawo do zmiany Regulaminu z ważnych przyczyn technicznych lub prawnych.
3. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy Kodeksu Cywilnego oraz Ustawy o prawach konsumenta.

Terms of Service

§ 1. General Provisions

1. These terms of service define the conditions and rules for using the website cvmajster.pl, hereinafter referred to as the Service.
2. The owner and administrator of the Service is the company CVmajster, contact e-mail address: kontakt@cvmajster.pl.
3. The Service provides electronic services consisting of a tool (creator) for creating documents (CVs, letters, invitations, posters) and generating ready PDF files (or ZIP files for invitations) for a fee.

§ 2. Terms of Use and Delivery of Services

1. The use of basic functions of the editor in the Service is free of charge.
2. Downloading the generated document in its clean version (without watermark and security hologram) is a paid service. The cost of a one-time generation and download of the document is 4.99 PLN gross.
3. Payments are processed through the external payment gateway 1koszyk.
4. In order to finalize the payment, the User is redirected to the payment service, where they are required to provide a correct e-mail address and select a payment method (BLIK, payment card, or fast transfer).
5. After payment, the User returns to the Service, where they unlock and download the file by entering the e-mail address used for the payment.

§ 3. Right of Withdrawal and Returns

1. In accordance with Art. 38 paragraph 1 item 13 of the Polish Act of 30 May 2014 on Consumer Rights (implementing the EU Consumer Rights Directive), the right of withdrawal from a distance contract **does not apply to the consumer** with respect to contracts for the supply of digital content which is not recorded on a tangible medium, if the performance has begun with the consumer's prior express consent before the expiry of the withdrawal period and after the entrepreneur has informed them of the loss of the right of withdrawal.
2. By clicking the purchase button and accepting these Terms of Service, the User consents to the immediate delivery of the generated PDF file before the expiry of the 14-day withdrawal period and acknowledges that they lose the right of withdrawal and refund.
3. The Owner guarantees the technical efficiency of the downloaded document.

§ 4. Complaints

1. In the event of technical problems with downloading the paid file or errors in its generation, the User has the right to file a complaint.
2. Complaints should be submitted via e-mail to: kontakt@cvmajster.pl, specifying the e-mail address used during the payment and a brief description of the issue.
3. The Administrator resolves complaints within 14 days of receipt. If the complaint is approved, the file will be sent directly to the client's e-mail or a refund will be processed.

§ 5. Final Provisions

1. The Terms of Service enter into force on the day of publication in the Service.
2. The Administrator reserves the right to change the Terms of Service for important technical or legal reasons.
3. For matters not covered by these Terms of Service, the provisions of the Civil Code and the Act on Consumer Rights apply.
